Terms and Conditions of Delulu

Executive Summary
These Terms and Conditions (the “Terms”) govern your use of Delulu (the “App” or “Platform”), a mobile application and website operated by DeluluWellness (the “Company”). Delulu connects Users (customers) seeking emotional support with Hosts/Listeners who provide empathetic audio listening. By accessing Delulu, you agree to abide by these Terms and our Privacy Policy. Key points include:
- Acceptance: Continued use of the App after any update constitutes acceptance of the Terms. We may modify these Terms at any time; please review them periodically. The latest version is always available on our website. Your continued use means you accept any changes.
- Eligibility: You must be at least 18 years old to use Delulu. Accounts are for personal use only; you may not use Delulu on behalf of others. A valid phone number and OTP verification are required for registration.
- Nature of Service: Delulu provides audio-only emotional-support calls between Users and Hosts. It is not medical, legal, or professional therapy. We act only as an intermediary platform and are not responsible for any advice or actions of Hosts. Hosts are independent providers; the Company disclaims liability for Hosts’ conduct or statements during calls. If you have medical or legal needs, please consult qualified professionals.
- Payments & Gifts: Users pay per call using standard payment methods (e.g. in-app payment gateways). There is no “wallet/coin” system. Users may purchase virtual gifts or premium features via in-app purchases; these items have no real-world monetary value. Gift revenue is split between the Host and Delulu as per our policy (e.g. X% to Host, Y% to platform, configurable). No refunds are issued for completed calls or gift transactions, except in cases of payment processing errors. Call rates, minimum balance (if any), and Host payouts are configurable.
- Conduct & Safety: All users must behave respectfully. Obscene, harassing, threatening, hateful, or illegal conduct is strictly prohibited. Do not share personal contact info (phone number, email, address, social handles, bank details, etc.) during or after calls. Do not attempt to solicit sexual acts or illegal services. Calls may be monitored or recorded by Delulu for quality and safety. Users may report any misconduct to support; Delulu will take appropriate action (see Reporting below).
- Account Security: Keep your account credentials confidential. You are responsible for any activity under your account. You must provide accurate profile information (name, phone, email, etc.) during registration. Only one account per person is permitted; duplicate or fake accounts will be suspended. Notify us immediately if you suspect unauthorized access.
- Refunds: Payments for calls and gifts are generally non-refundable once the service is provided. Refunds (up to the full amount charged) are only made if a technical error occurs (for example, a failed or duplicate payment) or if Delulu cancels the service before it starts. Refunds, if approved, will be issued via the original payment method within 7 working days of the request. Disputes should be raised via customer support first.
- Disclaimer: All services are provided “as is.” Delulu makes no guarantees regarding call availability, call quality, or any specific results. We expressly disclaim all implied warranties (including merchantability or fitness for a particular purpose). We are not liable for indirect or consequential damages, including loss of data or goodwill. Our total liability is strictly limited to the amount you paid for the affected service.
- Indemnification: You agree to indemnify and hold DeluluWellness and its affiliates harmless from any losses, claims, or expenses arising from your violation of these Terms or your misuse of the App. This includes any liability related to content you share, illegal actions by you, or infringement of others’ rights.
- Termination: You may delete your account at any time by contacting support. Email SupportDelulu@gmail.com with the subject “Delete Account” to request deletion. The Company may suspend or terminate accounts at its discretion for violations of these Terms or policies. Upon termination, any unused purchases or balances will be handled per our policies (e.g. forfeited or refunded as required by law).
- Governing Law & Disputes: These Terms are governed by Indian law (for example, the Indian Contract Act 1872 and the IT Act 2000). Any disputes will be subject to the exclusive jurisdiction of the courts in Ernakulam, Kerala. Before resorting to litigation, parties should attempt to resolve disputes amicably. If unresolved after 15 days, disputes will be referred to arbitration under the Arbitration and Conciliation Act 1996, seated in Ernakulam, Kerala. The arbitration decision will be final and binding.
- Grievance Redressal: Delulu has appointed a Grievance Officer to handle user complaints as per Indian IT rules. All grievances will be acknowledged within 24 hours of receipt, and Delulu aims to resolve complaints within 15 days. Please include details of your issue when writing.
1. Introduction & Definitions
- Company: DeluluWellness (the developer/operator of Delulu).
- Platform/App: The Delulu mobile application and website.
- Website: Any official Delulu website (e.g. www.delulu.com).
- User (Customer): A person using the App to connect with Hosts and receive calls.
- Host (Listener): A person providing emotional-support calls on the App after completing verification (KYC).
- Account: Your personal login account on Delulu.
- Services: The audio call sessions and related features provided by Delulu.
- Content: Any user-generated content (profile info, messages, voice content, etc.) on the Platform.
- Gifts & Virtual Items: Virtual tokens or gifts purchasable in-app (no cash value).
2. Acceptance of Terms
By downloading, registering, or using Delulu, you agree to these Terms. If you do not agree, do not use the App. We may update or change these Terms at any time; the “Last Updated” date at the end will reflect material changes. We encourage you to review the Terms periodically. Your continued use of Delulu after changes are posted constitutes acceptance of the new Terms. The Privacy Policy is incorporated by reference and governs data use.
3. Eligibility
You must be at least 18 years old and legally competent to enter this agreement. Accounts are for individual use only; you may not act on behalf of a company or other person. You must register with a valid Indian phone number and verify it via OTP. Only one account is allowed per person. Under no circumstance may you create an account on behalf of anyone else or allow multiple people to share one account.
4. Nature of Service (Disclaimer)
Delulu provides anonymous, audio-only listening and support sessions. Hosts are independent individuals who offer empathetic listening and conversation.
Not Medical or Legal Advice: Delulu is not a medical, psychological, or legal service. Hosts are not medical professionals or certified therapists. The App should not be used to diagnose or treat medical or mental health conditions. If you have such needs, seek qualified help.
Platform Intermediary: Delulu acts only as a platform connecting Users and Hosts. We do not guarantee the reliability, availability, or quality of individual Hosts. We expressly disclaim responsibility for any advice, declarations, or actions made by Hosts during a session. Any arrangements or issues between Users and Hosts (outside of the App) are between those parties.
5. Account Registration & Security
- Accurate Information: You agree to provide truthful and up-to-date information when registering (name, phone, email, profile photo, etc.). Delulu may require additional verification (e.g. a selfie or government ID) for certain features.
- Account Security: You are responsible for safeguarding your password, OTPs, and any device used to access the App. Do not share access with anyone. All activities under your account are attributed to you. Notify us immediately if you suspect any breach.
- One Account: You may maintain only one User account. Creating multiple or fake accounts is prohibited. We reserve the right to verify identity and deactivate suspicious accounts.
6. User Roles
- Customers (Users): People who use the App to call Hosts or send gifts. Users may request calls and purchase virtual gifts or premium services in-app. Users are responsible for ensuring they have sufficient balance or payment method for calls.
- Hosts (Listeners): Persons who provide support calls to Users. To become a Host, one must apply and pass verification (KYC) including identity proof (such as Aadhaar), a live selfie check, and verified bank account for payouts. Hosts set availability on the platform and must accept calls in good faith.
- Earnings & Payout: Hosts earn a share of call/gift revenue. The default split (e.g. 70% to Host, 30% to Company) is subject to change; specific rates will be posted in Host terms. A minimum payout threshold applies (e.g. ₹500, configurable). Host earnings are subject to TDS and other tax deductions as required by Indian law (such as the Income Tax Act). Payouts are made via the Host’s verified Indian bank account on a regular schedule.
7. Call Rules
- Audio Calls Only: The App currently supports voice calls only. (Video or text chat features are not available in this version.)
- Prohibited Content: Users and Hosts must not engage in any obscene, abusive, threatening, hateful, harassing, or illegal conversation. Soliciting sex, nudity, or violence is strictly forbidden.
- Privacy & Safety: Do not share personal contact details (phone number, email, address, social media, financial info, etc.) during or after calls. You may not arrange offline meetings or payments outside the App; such actions violate these Terms.
- Monitoring: Calls and interactions may be reviewed or recorded by Delulu for moderation and safety. Use of automated tools for voice analysis or moderation is permitted. We reserve the right to suspend or ban anyone found violating rules or engaging in harmful conduct.
8. Host Terms
- KYC Verification: Hosts must complete KYC (Aadhaar/UID, selfie, bank details) before providing services. Compliance with local laws (e.g. Intermediary Guidelines, KYC rules) is mandatory.
- Honest Availability: Hosts should only mark themselves “Online” when genuinely available to take calls. Repeated unavailability or misuse of status may lead to penalties.
- Earnings & Conduct: Hosts earn per-minute or per-call rates. Hosts must comply with all tax laws; Delulu will deduct applicable TDS from earnings before payout. Hosts must not request payment off-platform.
- Community Guidelines: Hosts must provide respectful, supportive conversation. Explicit sexual content or solicitation of sex is forbidden. Any form of harassment or hate speech by a Host will result in immediate suspension.
- Suspension: Delulu may suspend or terminate a Host’s account for policy violations, fraudulent activity, or after multiple complaints. During a suspension, the Host cannot receive calls or payouts.
9. Gifts & Virtual Items
Users can purchase virtual gifts or tokens via in-app purchases. Sending a gift deducts the corresponding amount from your payment method. These gifts are purely virtual and carry no cash value; they cannot be redeemed for money. Gift purchases are final and non-refundable. The revenue from gifts is shared between the Host and Delulu according to the prevailing policy (e.g. Host receives X%, Delulu retains Y%). These percentages are configurable and subject to change; the current split is provided to Hosts in writing.
10. Prohibited Conduct
Users and Hosts must not do any of the following:
- Engage in illegal activities (fraud, money laundering, hacking, terrorism, etc.).
- Impersonate another person or entity.
- Use hate speech, threats, or harassment.
- Share erotic, pornographic, or explicit sexual content.
- Record or distribute calls without the other party’s consent.
- Attempt to break or reverse-engineer the app, scrape data, or bypass payment channels.
Violation of these rules may result in immediate account suspension or termination.
11. Reporting, Blocking & Moderation
You may report any User or Host for misconduct via the in-app report feature or by contacting support. Delulu will review reports and may take action (warning, suspension, or banning) against violators. Delulu also reserves the right to proactively remove or block accounts and Content that violate these Terms or applicable law. As required by law, we will acknowledge any valid grievance within 24 hours of receipt and aim to resolve it within 15 days. During any investigation, accounts may be temporarily frozen.
12. Refund & Cancellation Policy
Payments for calls and gifts are final after delivery of service. We do not refund for calls that a User disconnects prematurely or for Hosts who terminate a session. Refunds are provided only if a payment error occurred (e.g. duplicate charge or technical failure) or if Delulu cancels a session before it starts. To request a refund, contact support with details of the issue. Approved refunds will be credited via the original payment method within ~7 working days. We are not responsible for any bank or processor delays.
13. Intellectual Property
All content on the Delulu Platform—including logos, designs, graphics, text, software, audio, and other materials—is owned by DeluluWellness or its licensors and is protected by Indian and international intellectual property laws. The look and feel of the App, the Delulu name and logo, and all copyrighted material are the property of DeluluWellness. You have a limited, revocable license to access and use the Platform solely for personal, non-commercial purposes in accordance with these Terms. You may not copy, reproduce, distribute, modify, or create derivative works from any part of the Platform without our express written permission. Any use of Delulu’s trademarks or branding requires prior consent.
14. User Content & Reviews
You are solely responsible for any content you provide (e.g. profile photo, bio, messages, reviews). Delulu may use your feedback or ratings in an anonymized form to improve services. We may remove or refuse to display any User Content that we believe violates the Terms (e.g. defamatory or inappropriate material). By submitting content or reviews, you grant DeluluWellness a perpetual, worldwide, royalty-free license to use, reproduce, and display that content in connection with the Service.
15. Limitation of Liability
Disclaimer of Warranties: The Services are provided “AS IS” and “AS AVAILABLE,” without warranties of any kind. Delulu disclaims all implied warranties (merchantability, fitness, accuracy, etc.) to the fullest extent permitted by law. We do not guarantee uninterrupted service or error-free operation.
Exclusion of Damages: Delulu shall not be liable for indirect, incidental, special, or consequential damages (including loss of profits, data, or goodwill) arising out of your use of the App. This includes any damages caused by Hosts or third-party actions.
Monetary Cap: In no event will DeluluWellness’s aggregate liability exceed the amount you paid for the single session or service giving rise to the claim. This cap applies even if the above limitations fail their essential purpose.
16. Indemnification
You agree to indemnify, defend, and hold harmless DeluluWellness, its officers, directors, employees, and affiliates from any claims, damages, losses, or expenses (including legal fees) arising from your violation of these Terms or any law, your misuse of the App, or your infringement of third-party rights.
17. Account Termination
By You
You may close your account at any time by contacting support (SupportDelulu@gmail.com) or using the in-app delete feature. See our Delete Account page for full instructions. After termination, all licenses granted to you under these Terms immediately cease. Any remaining user content may be permanently deleted.
By Delulu
We may suspend or terminate your account without notice if you breach these Terms or for any abusive or illegal activity. Upon termination, any unearned earnings (for Hosts) or unused credits (if applicable) will be handled per policy—typically forfeited unless law requires a refund. We may retain certain information as required by law.
18. Force Majeure
Delulu is not liable for any failure or delay in performance caused by events beyond our reasonable control (force majeure). This includes but is not limited to natural disasters, strikes, acts of war, government regulations, internet or telecom failures, power outages, or acts of God. In such events, services may be suspended until normal operations resume.
19. Governing Law & Dispute Resolution
These Terms and any disputes arising from them are governed by the laws of India. Jurisdiction is in Ernakulam, Kerala, India. In case of any dispute, both parties agree to first attempt good-faith negotiations. If unresolved within 15 days of notice, either party may seek arbitration in Ernakulam under the Arbitration and Conciliation Act 1996. The arbitration decision will be final and binding, and judgment may be entered in any competent Indian court.
